1 Scope of the GTC
These General Terms & Conditions (GTC) govern the legal relationship between the energy for future (EFF) foundation (seller) and its customers (buyers) with regard to all contracts concluded between the parties. Any provisions made by the buyer contrary to these GTC are herewith explicitly excluded. By placing an order, the customer agrees to these GTC.
The GTC apply to every order in the form that is visible on the homepage at the time of ordering.

2 Prices
All prices are quoted in Swiss francs (CHF). The individual prices are net and independent of the volume ordered.

3 Offer
The offer made by the seller is non-binding. Prices and product assortment are subject to change. Product information and illustrations are non-binding. The offer is always subject to availability on the part of the seller or a partner of the seller.

4 Conclusion of contract
The buyer makes a legally binding offer by submitting his/her order, donor application or corporate partner application at www.energyforfuture.org to conclude the contract.
By accepting the order, the seller contracts to deliver the item(s) as quickly as possible. The contract comes into force when the seller accepts the order by confirming the order by email and by delivering the goods.
The conclusion of the contract is always subject to availability on the part of the seller or a partner of the seller. The seller assumes no liability in the case of non-delivery due to a lack of inventory, supply shortage, obsolete products, etc.
Should the goods not be available in the desired amount or for the prices listed on the homepage, EFF will inform the customer as soon as possible. In such a case, the contract comes into effect only when the customer once again confirms the order by email.
The contract language shall be German or French.
Orders and agreements made by telephone only become valid once they are confirmed in writing or by email.

5 Payment
The customer must pay for the ordered items in advance.
When paying by credit card (VISA or MasterCard), Paypal or PostCard, the value of the goods will be charged on the day that the order is received. Amounts that have been charged for goods that subsequently cannot be delivered for any reason whatsoever will be credited again to the customer.
Should the customer wish to pay by invoice/bank transfer, EFF will provide its banking information and a reference number in the email with the order confirmation. The payment period is ten business days. If the order is not paid for within this period, the contract shall be dissolved.

6 Delivery

EFF normally delivers items within two to three days, and within 14 days at the latest from the time payment is made, provided that the ordered products are available from our warehouse.
No processing or shipping fees will be charged for orders delivered to Switzerland or Liechtenstein. If delivery is not made within 30 days, the buyer has the right to withdraw from the contract.
The seller is not liable for delivery delays caused by manufacturing companies, producers or third parties. The customer must inform energy for future, tel. 031 980 14 80, of incorrect deliveries within two days of receiving the goods.
Any costs resulting from the unavailability of goods are the responsibility of the buyer.

7 Returns
Ordered items may be returned to the following address within ten days of shipping (invoice date), together with the invoice and at the cost and risk of the buyer: energy for future, Meriedweg 11, 3172 Niederwangen BE.
Any items that have been opened or are in use are excluded from returns. The returned item must be complete, in its original package and undamaged. Otherwise, an amount decided upon by the seller may be deducted from the credited amount. The credited amount may never exceed the current price that is valid on the day of the return.

8 Warranty

EFF makes every effort to deliver goods in pristine condition. In the case of obvious defects, the buyer must report them within ten days of receiving the shipment. If defects come to the buyer’s attention at a later date, these must be reported as soon as possible. Otherwise, the goods shall be considered accepted.
The defective goods must be returned to the following address together with a copy of the invoice and a detailed description of the defect after reporting the defect beforehand by telephone (031 980 14 80): energy for future, Meriedweg 11, 3172 Niederwangen BE.
Any resulting shipping costs are to be paid by the buyer. In the event that a warranty applies, the seller shall decide if an exchange will take place. Damage caused solely by the buyer, e.g. as a result of inappropriate handling, normal wear or external influences for which the seller is not responsible, are excluded from the warranty.

9 Data security
Appropriate security technology will be used to protect customer data from unauthorised access. Nevertheless, EFF assumes no liability for the security of data sent through the internet.

10 Data protection
The seller shall adhere to the regulations of Swiss data protection legislation when collecting, processing and using personal data.

11 Changes to the GTC
The seller reserves the right to make changes to the GTC at any time.

12 Applicable law and place of jurisdiction
All of the contracts concluded on the EFF homepage are subject to Swiss law. For orders placed by private individuals for private use, the place of jurisdiction shall adhere to the jurisdiction law. In all other cases, Bern shall be the exclusive place of jurisdiction.
